Probate is the court-supervised process for settling a person's estate. In New Jersey it runs through the Surrogate's Court in the county where the person lived. Its job is simple: confirm who has legal authority to act, make sure debts get handled, and pass what remains to the heirs.

Authority comes first — before price, before repairs

A house titled solely in the deceased person's name generally can't be sold or refinanced until the court appoints an executor or administrator and issues what's called Letters Testamentary or Letters of Administration. Being named in the will is not the same as having that paper in hand. Until it exists, nobody can sign a listing agreement or a contract.

That's not a reason to sit still. While the appointment is processing you can secure the property, keep the insurance active, gather the mortgage and tax statements, and start the honest conversation between heirs about whether to sell as-is, prepare the home first, or keep it.

As-is or fixed up? Run the real math

Estate homes often carry decades of deferred maintenance, and families often assume they must renovate to sell. Sometimes the numbers agree — often they don't. The right answer compares what the work costs, what it returns in this specific market, and what the estate can actually front while the house sits.
